SELECTING and ORDERING PRODUCTS

The characteristics and price of the various products for sale on the Site (hereinafter “Product” or “Products”) are shown on the page relating to each Product (Product Sheet). To purchase the Products, the Customer must complete and submit the order form in electronic format, following the instructions contained on the Site. The Customer must add the Product to the “Cart” and after reviewing the General Conditions and Privacy Policy and confirming their acceptance, must enter the shipping and any billing details, select the desired payment method, and confirm the order.

By submitting the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares that they have reviewed all the information provided during the purchase procedure and fully accept these General Conditions and the payment terms set forth.

The Customer is strictly prohibited from entering false and/or invented data in the registration procedure and in further communications.

The contract entered into between Monban azienda agricola di Matteo Bisol and the Customer shall be deemed concluded upon acceptance of the order by Monban azienda agricola di Matteo Bisol. Such acceptance is communicated to the Customer through an order confirmation email containing a reference to these General Conditions, the order number, shipping and billing details, the list of Products ordered with their essential characteristics, and the total price, including delivery charges. The Customer will check the confirmation email and if they identify any errors in the order, they will have 12 (twelve) hours from receipt of such email to contact Customer Service directly from the Site by email: info@monban.it. After this period, the order will be processed for shipment and no further modifications will be accepted, without prejudice to the Customer’s rights under the following article.

Once the order is received, Monban azienda agricola di Matteo Bisol will verify the availability of its product warehouses to communicate any unavailability of some of them. In the event that one or more Products are not available, the Customer Service of Monban azienda agricola di Matteo Bisol will send prompt notification via email to the Customer who, within the following 24 (twenty-four) hours, will have the option to respond to confirm shipment of any other available Products or cancel it. In case of no response within this period, the order will be considered confirmed and the available Products will be
shipped. In this case, the entire amount relating to the missing Products will be reversed and refunded to the Customer.

PREAMBLE and EFFECTIVENESS of the GENERAL CONDITIONS

These general conditions of sale (hereinafter, “General Conditions”) govern the purchase of products and services, carried out remotely and made available via the internet through the website www.monban.it (hereinafter, the “Site”) in compliance with Italian legislation pursuant to Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, “Consumer Code”) as well as the regulations on electronic commerce pursuant to Legislative Decree 70/2003. The consumer who accesses the Site to make purchases (hereinafter “Customer”) is required, before submitting the order, to carefully read these General Conditions which have been made available on the Site and which may be consulted at any time by the Customer also through the link contained in the confirmation email of each order to allow reproduction and storage.

The Customer is invited to print or save the General Conditions according to their preferred methods. In case of changes to the General Conditions, the purchase order will be subject to the conditions published on the site at the time the order is submitted by the Customer. In the event that the person making purchases on the Site requests the issuance of an invoice and/or is not a “consumer or user” as defined in art. 3, paragraph 1, letter a), of the Consumer Co
de, the withdrawal provisions referred to in art. 7 and 8 of these General Conditions will not apply, nor, more generally, the provisions that under the same Consumer Code apply only to “consumers”.

Contracts concluded with Monban azienda agricola di Matteo Bisol through the Site are governed by these General Conditions in compliance with Italian law. The language available for concluding the contract is Italian.

PRODUCT INFORMATION

Information and characteristics relating to the Products are available on our Site. The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the descriptive sheet. It is understood that the image of the Products themselves has the sole purpose of presenting them for sale and may in some rare cases not be perfectly representative of their characteristics and qualities but may differ in color and dimensions. In case of difference between the image and the product sheet we have described, the description of the product sheet always prevails. In any case, it is specified and requested, relieving us of any other liability on our part, to carefully check the label placed on the product once it is in your hands.

ERRORS and LIMITATIONS of LIABILITY

Information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors due precisely to the constant updating of the same, errors for which Monban azienda agricola di Matteo Bisol cannot therefore be held responsible, except in case of willful misconduct or gross negligence.

Monban azienda agricola di Matteo Bisol reserves the right to correct errors, inaccuracies, or omissions even after an order has been submitted, or to modify or update information at any time without prior notice, without prejudice to the Customer’s rights under these General Conditions and the Consumer Code. The Customer is therefore permitted to request, in such case of error, a refund of the expense upon mandatory return of the Product(s) in which such possible informational error by Monban azienda agricola di Matteo Bisol was found by the Customer. In this case, the shipping costs of the returned Product(s) are borne by Monban azienda agricola di Matteo Bisol.

Except in case of willful misconduct or gross negligence, any right of the Customer to compensation for damages or recognition of an indemnity is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property caused by non-acceptance or fulfillment, even partial, of an order.

Monban azienda agricola di Matteo Bisol promotes responsible consumption of alcohol and excludes any liability on its part, except in case of willful misconduct or gross negligence, in the event of purchase made by persons under 18 years of age.

RIGHT OF WITHDRAWAL – EXCLUSIONS

Since the order confirmation initiates the order execution process by the principal, Monban azienda agricola di Matteo Bisol avails itself of the exclusion of the right of withdrawal pursuant to and for the purposes of art. 59 paragraph 2 letter d) and e) of Legislative Decree 206/2005
